Congressman Clay Higgins (R-LA) has reintroduced the Homeland Security Fentanyl Enforcement Act of 2023, a bill aimed at combating drug cartels and addressing the fentanyl crisis. The legislation would grant Homeland Security Investigations (HSI) the authority to enforce drug crimes independently for a period of five years. Currently, HSI agents rely on the Drug Enforcement Administration (DEA) to investigate drug-related offenses under Title 21.

The bill, developed in consultation with frontline DHS law enforcement officers, seeks to empower HSI with the necessary tools to effectively combat transnational criminal organizations. By granting HSI full Title 21 authority, the legislation aims to enhance their ability to target and dismantle drug cartels operating along the southern border.

In a statement, Congressman Higgins highlighted the urgency of the situation, stating, "Criminal cartels have control of our southern border and we need every resource available to restore law and order." He emphasized that HSI's lack of independent statutory authority to enforce drug crimes is hindering their efforts to combat transnational criminal organizations, calling it "absurd."

The Congressman further explained that the bill would add thousands of highly skilled federal law enforcement officers to the fight against drug trafficking, without placing an additional burden on American taxpayers. The primary objective of this legislation is to keep deadly drugs, particularly fentanyl, out of our communities and ensure the safety of America's borders.
